These Terms of Service ("Terms") govern your access to and use of the CheckMasterAI platform ("Service") operated by CheckMasterAI ("we", "our", or "us"). By accessing or using the Service, you agree to be bound by these Terms.

1. Description of Service

CheckMasterAI is an AI-powered visual inspection management platform that enables organisations to capture on-site photos, receive automated cleanliness and compliance scores, manage multi-branch inspection workflows, and maintain digital audit trails. The Service is provided as a software-as-a-service (SaaS) platform accessible via web browser and mobile application.

2. Account Responsibilities

Access to the Service is granted by an administrator of your organisation. You are responsible for:

• Maintaining the confidentiality of your login credentials.
• All activity that occurs under your account.
• Notifying your administrator immediately of any unauthorised use of your account.

3. Acceptable Use

You agree to use the Service only for its intended purpose. You must not:

• Submit inspection photos that were not taken in real time at the inspected location (e.g. photos taken from a screen, gallery uploads, or pre-existing images).
• Attempt to manipulate, deceive, or game the AI scoring system.
• Use the Service to store, transmit, or process content that is unlawful, harmful, or violates the rights of others.
• Reverse engineer, decompile, or attempt to extract the source code of the Service.
• Use the Service in a manner that disrupts, damages, or impairs its availability or functionality.

4. Photo Submissions and Anti-Fraud

The Service includes automated fraud detection that analyses submitted photos for signs of screen capture or non-genuine imagery. Submissions flagged as fraudulent are recorded in the audit trail but excluded from compliance statistics. Repeated fraudulent submissions may result in account suspension.

5. AI Analysis Disclaimer

Inspection scores and feedback are generated by third-party AI providers (OpenAI, Google Gemini, Anthropic Claude) and are provided for informational purposes only. CheckMasterAI does not guarantee the accuracy, completeness, or fitness for purpose of any AI-generated output. AI results should not be used as the sole basis for compliance decisions.

6. Intellectual Property

All rights, title, and interest in the Service, including its software, design, and content, remain the property of CheckMasterAI. Inspection photos submitted by users remain the property of the submitting organisation. You grant CheckMasterAI a limited licence to process submitted photos solely for the purpose of providing the Service.

7. Limitation of Liability

To the maximum extent permitted by applicable law, CheckMasterAI shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount paid by you for the Service in the twelve months preceding the claim.

8. Service Availability

We strive to maintain high availability but do not guarantee uninterrupted access to the Service. We reserve the right to suspend the Service temporarily for maintenance, updates, or circumstances beyond our control.

9. Termination

We reserve the right to suspend or terminate access to the Service for any account that violates these Terms, without prior notice. Upon termination, your right to use the Service ceases immediately.

10. Governing Law

These Terms are governed by the laws of the Republic of Turkey. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of Istanbul, Turkey.

11. Changes to These Terms

We may update these Terms from time to time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms.
